WHAT YOU WILL LEARN:
You will learn what the lenders and their attorneys don't want you to know. There are two types of foreclosures depending on what state you live in, JUDICIAL and NON JUDICIAL. These seminars are scheduled and arranged by Judicial and Non Judicial states so that the only the information you need is presented.
JUDICIAL: In JUDICIAL foreclosure states such as Florida, the lender must take you to court, file all the proper documents required by the court and request and have a hearing in front of a judge. A judge will then rule, based on the evidence presented by both the plaintiff and you, the defendant.
Based on evidence the judge will decide. If the judge rules in favor of the plaintiff, you lose, a sale date will be set and your house sold by the court, sometimes called a Sheriff's sale. You will then be given a certain amount of time to leave and take all of your belongings.
This seminar will teach you how to represent yourself in court against the lenders attorneys. Representing yourself is called PRO SE.
NON JUDICIAL: In Non Judicial states, the lender can after proper notice sell your house at auction WITHOUT having to go to court. In other words, they do not need a judge to rule and no evidence is presented in a court. However, you still have legal rights and you can bring the lender into a court PRO SE, present your case and a judge will have to rule.
EVERYONE has the right to defend themselves in a court of law in this country and you do not need an attorney to do so. Of course, if you can afford one, it is always advisable to seek their advice and counsel.
HOW TO FILE and WHAT TO FILE:
Courts are very intimidating places no matter what it is you need to go there for. The legal system has its own rules of order and proceedure. It always seems that masses of papers are filed with the courts in language the average person has problems understanding.
You will learn how to file and what to file properly. You do not need too know legaleeze to create the documents you file in court. We will show you how.
WHERE TO FIND INFORMATION:
We will show you how to find information about your case as well as others that may help you fight yours. Gathering information and staying on top of information can help you stay in your home longer.
WHAT TO DO IN COURT:
You will learn what to expect when you go to court. How to handle yourself, what you can and cannot do, how to bring witnesses or question other witnesses or opposing counsel. We will teach you what not to do and say in court. What may anger a judge and turn them against you. You will learn NOT to be intimidated by either the lender's attorney or the judge. In fact, you will learn how not to be intimidated by the whole system.
WHAT LEGAL TRICKS MAY BE USED AGAINST YOU:
Yes, there are legal tricks some lawyers use because they can get away with them. They get away with them because the defendant does not know what to do or what to look out for. We will teach you what to look out for and what to do if a trick is used against you.
CASE HISTORIES:
We will provide you actual case histories from actual mortgage foreclosure cases. Inclluded will be MOTIONS filed by both sides and final rulings by judges that can be used to your advantage. Case history can be produced to prove your point. Case history is almost always used.
We will give you actual cases that you can follow through each action that is taken or occurs. We will provide you initial filings, Summons served on you, Motions filed by both sides and final disposition of cases. You will see actual cases that have either been going on for years with the people still living in their homes without making any mortgage payments. You will see cases where the lenders forclosure action has been DISMISSED by the court, meaning that the judge ruled against the foreclosure action by the lender and THEY CANNOT TAKE YOUR HOUSE.
You will learn how mortgages work, understand the documents you signed and how those documents that you did not understand can work to your benefit.
